A comedy of errors: Wrong, again.

Here's another laugh from our friends over in crazy-town.
Therefore this will constitute a formal complaint against the Andre Carson campaign. Over the last week or so, Mr. Carson's campaign has had two press conference in which Marion County Sheriff's deputies, dressed in their full uniform have been seen in plain view of the camera. This of course is illegal, not only for the Andre Carson campaign, but also for those deputies involved.
The claim is that police officers who appear in uniform in a campaign-related photograph are somehow in violation of the Indiana Code. The gang then goes on to cite the following statute as evidence.
IC 3-14-1-6 Solicitation, challenge, or performance of election function by state police department employee, police officer, or firefighter

Sec. 6. (a) A state police department employee or a police officer or firefighter (including a special duty, auxiliary, or volunteer police officer or firefighter) of a political subdivision who recklessly:

    (1) solicits votes or campaign funds;

    (2) challenges voters; or

    (3) performs any other election related function;while wearing any identifying insignia or article of clothing that is part of an official uniform or while on duty commits a Class A misdemeanor...
Careful readers, of course, notice that the part they leave out is what immediately follows the statute they so hilariously cite.
(b) This section does not prohibit any of the following:
    (1) A state police department civilian employee from voting while on duty.

    (2) A police officer or firefighter from voting while wearing any part of an official uniform or while on duty.

    (3) An individual described in subsection (a) from consenting to a photograph (or other visual depiction) of the individual wearing any part of the individual's official uniform appearing in an advertisement in support of a candidate or political party.
Whoops. Beyond this they have nothing more than their usual concoction of baseless conjecture and wild speculation. From a self-described "Citizen Activist" who is actually just a failed, disgruntled Republican candidate for City County Council, no less.

And it's also worth noting that this piece of code was actually intended originally to protect African American districts from voter intimidation on the part of uniformed officers. That's why you see the statute refer to "challenging voters" in the above citation. The irony isn't lost on me.

On a related note: Am I the only one who takes great pleasure in watching someone who endlessly complains about the local media copy and paste nearly their entire articles into his blog posts?

And you want to talk about a violation of fair use...Jeesh.
